| Filing 6 MINUTE entry before the Honorable Harry D. Leinenweber: Upon receiving an application to proceed in forma pauperis, the Court screens the underlying complaint to determine whether the action should be dismissed for failure to state a claim upon which relief can be granted. 28 U.S.C. 1915(e). Plaintiff Reyes' complaint #1 alleges constitutional violations from private individuals, presumably her landlords. The Bill of Rights in the U.S. Constitution regulates government action and not the action of private individuals. Even assuming Reyes' landlords receive Section 8 housing funds, this does not make those persons state actors. Norman v. Campbell, 87 F. App'x 582, 584 (7th Cir. 2003). To the extent that Reyes' allegations constitute violations of state landlord-tenant law, she must pursue her claims in state court. Reyes application to proceed in forma pauperis #4 and motion for attorney representation #5 are denied. The case is dismissed. Mailed notice (maf) |
