ORDER: Stateville Correctional Center inmate Clarence Trotter has filed a 28 U.S.C. 2254 petition to challenge his 2013 murder conviction in Cook County Circuit Court Case No. 07 CR 3851. This Court, in Case No. 08 C 2917, dismissed Trotter's other 2254 petition, which challenged a different murder conviction (Cook County Circuit Court No. 86 CR 10969). Trotter's current 2254 petition, however, is not on the Court's form as required by N.D. Ill. Local Rule 81.3. Use of the proper form is necessary in this case since Trotter states that at least one of his claims is pending in state court, but the petition provides no information about his state post-conviction proceedings. The current petition is thus dismissed without prejudice to him filing an amended one. Also, Trotter initiated this case without paying the $5.00 filing fee or submitting an in forma pauperis (IFP) application showing his inability to pay.To proceed with this case, Trotter must, by September 13, 2021: (1) submit an amended 2254 petition using this Court's form; and (2) satisfy the filing fee requirement either by paying $5.00 with a check or money order made payable to Clerk, United States District Court, Northern District of Illinois, or by filing a completed IFP application. The Clerk shall send Trotter a 2254 form and an IFP application. Trotter's failure to comply with this order will result in dismissal of this case. Signed by the Honorable Mary M.
