| Filing 6 MINUTE entry before the Honorable John Z. Lee: Given Plaintiff Valentine Akpa's application for leave to proceed in forma pauperis #4 , the Court has conducted an initial screening of his complaint #1 pursuant to 28 U.S.C. 1915. See Rowe v. Shake, 196 F.3d 778, 783 (7th Cir. 1999). For the reasons stated herein, the Court dismisses Akpa's complaint with prejudice as frivolous. See 28 U.S.C. 1915(e)(2)(B)(i). Akpa's complaint in this case brings claims against the defendants in an earlier filed employment discrimination case that Akpa currently has pending before this Court, as well as the defendants' lawyers in that case. See Akpa v. Northwestern Memorial Healthcare et al., No. 18 C 7512 (N.D. Ill. filed Nov. 13, 2018) (Lee, J.) ("Akpa I"). These claims are based entirely on allegations of fraudulent conduct during discovery in Akpa I that the Court has found to be "entirely baseless," and borderline sanctionable, when Akpa raised them in that case. See 5/19/21 Order at 8-9, Akpa I, ECF No. 214 (Fuentes, M.J.); see also 6/28/21 Order at 4, Akpa I, ECF No. 227 (Lee, J.); 9/25/19 Order at 2, Akpa I, ECF No. 109 (Lee, J.).Because Akpa's allegations of discovery fraud lack an arguable basis in fact, they are factually frivolous. See Felton v. City of Chi., 827 F.3d 632, 635 (7th Cir. 2016). And because amendment would be futile, the dismissal is with prejudice. Akpa's application for leave to proceed in forma pauperis is stricken as moot. Civil case terminated. (ca, ) |
