Filing 7 ORDER : By order dated September 20, 2021 #5 , the Court directed Plaintiff to show cause as to why this case should not be dismissed for failure to exhaust his administrative remedies prior to filing suit, and advised him that failure to comply by October 15, 2021, would result in summary dismissal of this case without prejudice. As of today's date, Plaintiff has not responded, and the Court has not heard from Plaintiff since entry of the September 20, 2021, order #5 . Accordingly, this action is dismissed without prejudice pursuant to Fed. R. Civ. P. 41(b). See Fed. Election Comm'n v. Al Salvi for Senate Comm., 205 F.3d 1015, 1018 (7th Cir. 2000) (court has authority both inherently and under Rule 41(b) to dismiss case as sanction for failure to prosecute and noncompliance with court order). Having brought this action, Plaintiff remains obligated to pay the filing fee. See 28 U.S.C. 1915(b)(1). The Court directs the Clerk to enter a final judgment of dismissal. This case is closed. Filing 5 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $21.15 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee, and to make monthly deductions in accordance with this order. The Clerk of Court is directed to electronically send a copy of this order to the Supervisor of the Inmate Trust Fund Accounts at the Cook County Jail. Summonses, however, shall not issue at this time. Based on dates given in the complaint, Plaintiff is ordered to show good cause in writing why the complaint should not be dismissed for his failure to exhaust administrative remedies before initiating this lawsuit. Failure to respond to this order by October 15, 2021, will result in dismissal of this action without prejudice for failure to exhaust.
