Filing 11 Second AMENDED complaint by David Luperini against All Defendants (Jordan, Jess) |
Filing 10 ORDER: On September 27, 2021, the Court dismissed this case sua sponte for lack of jurisdiction because Plaintiffs complaint did not adequately plead the amount-in-controversy necessary to establish diversity jurisdiction. Dkt. #6 . Plaintiffs counsel moved to amend the complaint but did not include a proposed amended complaint. The Court ordered Plaintiff to file a proposed amended complaint, "which must address the jurisdictional deficiencies identified in the Court's September 27, 2021 order." Dkt. #8 . Plaintiffs counsel filed a proposed amended complaint, which revised the caption to correctly read that this matter is in the Eastern Division of the Northern District of Illinois, rather than the Western Division. Dkt. #9 . However, Plaintiffs counsel did nothing to correct the jurisdictional deficiencies. Plaintiff shall file an amended complaint addressing those jurisdictional deficiencies by no later than October 21, 2021 or Plaintiffs motion to amend will be denied. IT IS SO ORDERED. Signed by the Honorable Charles R. Norgle, Sr on 10/4/2021: Mailed notice. (rc, ) |
