In light of the dismissal of this case on 04/12/2022 #11 #12 , the Court cannot consider the pending motion while this case remains dismissed. Further, the case was dismissed for lack of subject matter jurisdiction, and the Court is without any authority to make an exception to the statutory requirement that Plaintiff commence a new action in an Illinois state court within one year of the Court's prior order dismissing this matter, pursuant to 735 ILCS 5/13-217. The Court makes no finding as to whether Plaintiff can commence an action outside of the timeframe specified in 735 ILCS 5/13-217. However, Plaintiff is free to file an action in an Illinois state court and to present her arguments to a Court with subject matter jurisdiction over her action regarding any tolling of 735 ILCS 5/13-217.
