Filing 1 ORDER: Defendants' motion to dismiss 45 is granted as follows. Counts III, VI, IX, and XII are dismissed. Counts X and XI are severed; Plaintiff may proceed with those claims in a separate action under a separate case number. The Court directs the Clerk of Court to open a new civil action and to docket under the new case number: (1) this Order as Docket Entry Number 1, and (2) the Second Amended Complaint from Case No. 18-cv-05184 22 as Docket Entry Number 2. The Second Amended Complaint shall be deemed received in the new case as of 2/27/2020. To proceed with the new action, Plaintiff must either pay the full $400 filing fee, or submit an application to proceed in forma pauperis that includes a certified copy of his trust fund account statement ( or institutional equivalent) for the six-month period immediately preceding the filing of the Second Amended Complaint-i.e., the six-month period beginning approximately8/27/2019. See 28 U.S.C. 1915(a)(2). If Plaintiff fails either to pay the filing fee or request leave to proceed in forma pauperis by 10/26/2021, then the new case will be dismissed and closed.
