Panel advises parties that although no live testimony will be needed, this case is set for a hearing and oral argument to begin on 12/7/2021 at 9:00 a.m. in the James B. As all concerned recognize, this litigation must proceed expeditiously and must conclude in time for the candidates to participate in, and the Board of Elections to administer, a primary election in 2022. The members of the panel (and the assigned Magistrate Judge) have endeavored to fairly balance the parties' needs to develop the facts, expert opinions, and legal briefs with the panel's need to render a reasoned decision in time for any appeals prior to the date by which nominating petitions must be circulated. We do that again today in considering the instant motion. As the Legislative Defendants point out, it is a considerable task to respond to the submissions of three sets of Plaintiffs. At the same time, the extension requested will push Plaintiffs to the cusp of the Thanksgiving holiday when their reply period starts. The panel will provide some relief to each side on these deadlines: Defendants' submissions are now due on 11/24/2021 no later than 2:00pm CST; Plaintiffs' reply submissions are now due on 12/1/2021 no later than 10:00am CST. The panel also advises that any potential trial/hearing will take place in-person in the James B. Parsons Ceremonial Courtroom, on the 25th Floor of the Dirksen Federal Building starting on Tuesday, December 7. Given the December 7 starting date, the parties will now be able to conduct depositions on December 1, 2, 3, and 6 if necessary. The panel will communicate further details about the logistics for the court proceedings during the week of November 29, including the exact starting time and all of the protocols required to ensure social distancing during the pandemic. That communication will also include directions for media and members of the public who may wish to attend the proceedings.
