November 8, 2021 Opinion or Order Filing 5 ORDER Signed by the Honorable Franklin U. Valderrama on 11/8/2021: Petitioner Walter Smith (Petitioner), currently confined at the Chester Mental Health Center, has filed a 28 U.S.C. 2254 petition in this Court. Petitioner contends that the Cook County Circuit Court never set a Thiem date after involuntarily committing him following his not-guilty-by-reason-of-insanity verdict. See People v. Thiem, 403 N.E.2d 647 (1980). The 2254 petition cannot proceed, however, as Petitioner has neither paid the $5.00 filing fee, nor submitted an in forma pauperis (IFP) application demonstrating his inability to pay. By December 13, 2021, Petitioner must satisfy the filing fee either by paying it with a check or money order (made payable to Clerk, United States District Court) to the Clerk, United States District Court, 219 South Dearborn Street, Chicago, Illinois 60604, attn: Cashier's Desk, 20th Floor, or by submitting a completed IFP application that includes, if available, a copy of his trust fund account at his facility. An official at his facility should be able to assist if needed. The Clerk of Court shall send an IFP application to Petitioner, along with a copy of this order. Petitioner's failure to comply with this order will result in summary dismissal of this case without prejudice. See N.D. Ill. Local Rule 3.3(f). Mailed notice (axc).
