Filing 7 ORDER: By order dated October 26, 2021, the Court denied Plaintiff's application for leave to proceed in forma pauperis and ordered him to pay the Court's $402.00 filing fee #6 . The Court warned Plaintiff that failure to comply by November 16, 2021, would result in dismissal of this case. Plaintiff has not paid the fee or otherwise responded to date. Accordingly, this case is dismissed without prejudice. Plaintiff's motion for attorney representation #4 is denied as moot. Case closed. Signed by the Honorable Virginia M. Kendall on 11/30/2021. Filing 6 ORDER: The Court denies Plaintiff's application for leave to proceed in forma pauperis #3 because (1) the trust fund statement attached to the application shows that he had enough money in his account to prepay the $402.00 filing fee in full on the date the application was certified, and (2) he received more than $4,900.00 credited to his account during the six months immediately preceding his initiation of this lawsuit. In other words, Plaintiff could have submitted payment of the $402.00 filing fee along with his complaint if he chose to do so. He must prepay the fee if he wants to proceed further. Plaintiff may pay by check or money order payable to Clerk, United States District Court. He should mail payment to Clerk, United States District Court, 219 South Dearborn Street, Chicago, Illinois 60604, attn: Cashier's Desk. Failure to remit the fee by November 16, 2021, will result in summary dismissal of this case. The Court defers initial review of Plaintiff's complaint under 28 U.S.C. 1915A and ruling on his motion for attorney representation until after he has paid the filing fee. The Court directs the Clerk of Court to correct the spelling of Plaintiff's name on the docket to reflect the name under which he is incarcerated, see [3, pg. 5], before sending Plaintiff a copy of this order. Signed by the Honorable Virginia M. Kendall on 10/26/2021. Mailed notice (nsf, ) |
