Filing 5 ENTERED JUDGMENT on 12/16/2021. Mailed notice. (jjr, ) |
Filing 4 MINUTE entry before the Honorable Steven C. Seeger: On October 29, 2021, this Court entered an order directing Plaintiff to pay the filing fee or submit an application to proceed in forma pauperis, and do so by November 29, 2021. (Dckt. No. #3 ) The Court also directed Plaintiff to file an amended complaint by November 29, 2021. Plaintiff did none of the above. The case is dismissed. Civil case terminated. Mailed notice. (jjr, ) |
Filing 3 MINUTE entry before the Honorable Steven C. Seeger: The Court received the complaint, but Plaintiffs did not pay the filing fee or submit an application to proceed in forma pauperis. Plaintiffs must pay the filing fee or file an application to proceed in form pauperis by November 29, 2021. A failure to pay the fee or submit an application by that deadline will lead to dismissal. The Court also notes that the complaint is unsigned, and the name "Plaintiff PRINCE" appears on the last page. There are two problems with that approach. First, Rule 11 expressly requires every pleading to be "signed" by an attorney or by the party itself. See Fed. R. Civ. P. 11(a). Here, there is no signature. Second, the caption of the complaint includes six people with the last name of "Prince," such as "Ingrid Prince," "Angel Prince," and so on. So the complaint is stricken. The Court grants Plaintiffs leave to file an amended complaint by November 29, 2021, but it must be signed by every Plaintiff or by an attorney who enters an appearance. A failure to comply will lead to dismissal. Mailed notice (jjr, ) |
