Filing 6 MINUTE entry before the Honorable Edmond E. Chang: Emergency telephone motion hearing held. Counsel for the parties appeared by telephone. As discussed during the hearing, the motion #4 of Third-Party Plaintiff Tsinman to stay state court case is granted, with apologies to the state court. It was unwise for Tsinman's counsel to simply inform the state court, without leave of the state court, that counsel would not appear for the 9:00 a.m. hearing and the 2:00 p.m. arbitration. Counsel should have appeared to further explain Tsinman's position. Ideally, the removal would have happened more promptly after the 10/01/2021 notice to the local USAO so that the state court would not have allocated resources unnecessarily and be put in this position. Having said that, it does appear that the DOJ did not learn of the 10/27/2021 arbitration date until late Friday afternoon on 10/22/2021. The command of 28 U.S.C. 1446(d) is clear that the state court shall not proceed further until the case is remanded. So the state case is stayed. Government counsel reported (and the Stegers' attorney confirmed) that there are e-filing obstacles in state court right now; the local USAO plans on filing the notice of removal with the state Clerk in-person today. The parties (all three sets) shall confer with one another to try to reach a resolution in good-faith (including, tangentially, formal service of process on the federal government). If the conferrals are unsuccessful, then the Court will set the litigation track, including answers or motions in response to the Third-Party Complaint. Telephone status hearing set for 11/10/2021 at 10:00 a.m. Members of the public and media will be able to call in to listen to this hearing. Counsel of record and the Probation Officer will receive an email before the start of the telephonic hearing with instructions to join the call. Persons granted remote access to proceedings are reminded of the general prohibition against photographing, recording, and rebroadcasting of court proceedings. Violation of these prohibitions may result in sanctions, including removal of court issued media credentials, restricted entry to future hearings, denial of entry to future hearings, or any other sanctions deemed necessary by the Court.
