Filing 10 COMPLAINT filed by Anna Renee Burke; Jury Demand. (pj, ) |
Filing 9 ORDER: Plaintiff Anna Burke's petition to proceed in forma pauperis #8 and her motion for attorney representation #4 are granted. The Court has authority under 28 U.S.C. 1915(a)(1) and (e)(1) to authorize the commencement of any suit without the prepayment of fees and request an attorney to represent any person unable to afford counsel. The Court's review of the pro se complaint reveals a potential claim that a state-run agency denied Burke her due process and fourth amendment rights. The Court finds that a court-appointed attorney would greatly assist the Court in determining the merits of Burke's suit. Further, although Burke is a professional speech pathologist, the allegations in the complaint have inhibited her ability to work in a full-time capacity, and she is currently without a permanent residence. The Court directs Plaintiff Burke to update the Court if she is able to resume access to her prior assets or finds full-time employment. The Court recruits Robert S. Reda, Reda & Des Jardins, Ltd., 736 North Western, Suite 353, Lake Forest, Illinois, 60045, (847) 809 - 4567, robert@rdlawyers.com, to represent the plaintiff. Telephonic status conference is set for 1/27/22 at 9:30 a.m. Dial: 888-684-8852 or 215-446-0155, access code: 9582710#, security code: 8115. Joint status report shall be filed by 1/20/22. Signed by the Honorable Harry D. Leinenweber on 11/19/2021. Mailed notice (pj, ) |
Filing 8 APPLICATION by Plaintiff Anna Renee Burke for leave to proceed in forma pauperis. (aee, ) |
Filing 7 MINUTE entry before the Honorable Harry D. Leinenweber: Plaintiff Burke's motion for attorney representation #4 is entered. A federal court may permit a party to proceed without prepayment of fees and appoint an attorney to represent any person unable to afford counsel. 28 U.S.C. 1915(a)(1), (e)(1). In order to make this determination, Burke first must submit an In Forma Pauperis Application and Financial Affidavit ("IFP Petition") as described in 28 U.S.C. 1915(a)(1). Burke can obtain the IFP Petition from the Clerk's office or from the Northern District of Illinois website. The Court continues the motion to allow Burke the opportunity to file the IFP Petition. If Burke does not file an IFP Petition by 12/8/2021, the motion #4 is denied. Mailed notice(maf) |
