Filing 7 MINUTE entry before the Honorable Manish S. Shah: Plaintiff initiated this pro se lawsuit while in custody and without pre-paying the $402.00 filing fee or submitting an in forma pauperis application. Plaintiff has since been released from custody. The Court directed Plaintiff to submit a properly completed IFP application showing his current financial and employment status and with copies of his prison trust fund statements showing activity in his trust fund account for the six-month period preceding the filing of this lawsuit, or from approximately April 21, 2021, through Oct. 21, 2021. Plaintiff has submitted an in forma pauperis application #6 using another court's form and which does not disclose any means of support other than "$13 per month from state and inconsistent donation." See #6 at pg. 2. It is unclear if the $13 per month refers to state pay Plaintiff received while in prison, and it is unclear what he means by "inconsistent donation" or how he is supporting himself after his release from custody. Plaintiff also has not submitted the required trust fund statements. The Court denies Plaintiff's in forma pauperis application #6 without prejudice to Plaintiff submitting a renewed application, on the Court's required form, that explains his current means of support, along with the required trust fund statements. Alternatively, Plaintiff may pre-pay the $402.00 filing fee. Failure to take either action by 3/18/22 will result in summary dismissal of this action. The Clerk is directed to send Plaintiff a blank IFP application (non-prisoner) and a copy of this order. Notices mailed. (psm, ) |
