November 9, 2021 Filing 12 MINUTE entry before the Honorable Edmond E. Chang: On review of the complaint, Judge Chang posts this notification for the parties. Absent the exclusion in Paragraph 52(2), R. 1, Compl. para. 52(2), the proposed class definition would have included Judge Chang and his spouse, Compl. para. 51. Although the exclusion has been alleged, in an abundance of caution, Judge Chang proposes that he and his spouse renounce class membership and waive the claims brought on behalf of the proposed class. In the upcoming joint initial status report, see R. 9-1, the parties shall include a section stating whether they agree to the proposal or whether they need more information. The tracking status hearing of 12/08/2021 is reset to 12/23/2021 at 8:30 a.m., but to track the case only (no appearance is required, the case will not be called).
