Filing 9 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is conditionally granted, although the Court lacks the information necessary to calculate an initial partial filing fee. For now, the trust fund officer at Plaintiff's place of incarceration is directed to make continuing monthly withdrawals in accordance with this order. To continue with this case and to maintain in forma pauperis, however, Plaintiff must by January 18, 2022: (1) submit an application for leave to proceed in forma pauperis with a trust fund account statement obtained from an appropriate prison official (such as an officer on his unit team staff) that includes both a summary showing deposits and withdrawals over the previous six months and a detailed transaction report of all deposits and debits from May 9, 2021 through the date he obtains it, so that the Court can assess an initial partial filing fee; (2) if Plaintiff was not incarcerated for any of the six-month period prior to filing suit (as it appears he was) he must respond truthfully and accurately to the questions in the application regarding income and assets for that time period; and (3) return and complete a USM-285 form for service for Defendant Dart. Should Plaintiff fail to comply with these directives, or if he fails to keep the Court apprised of his current address, this case will be subject to dismissal. Because Plaintiff has "struck out" under 28 U.S.C. 1915(g), and he is the subject of a Seventh Circuit barring order, Plaintiff's in forma pauperis status is subject to revocation, and this case may be subject to dismissal if his allegations of imminent danger are untrue. The Court directs the Clerk to (1) send a copy of this order to the trust fund officer at the facility currently having custody of Plaintiff and to the Court's Fiscal Department; (2) file Plaintiff's complaint #1 ; (3) issue summons for service of the complaint on Defendant Dart, to be served by the Clerk's office as directed below; and (4) sen Plaintiff a blank USM-285 (Marshals service) form, an application for leave to proceed in forma pauperis, filing instructions, and a copy of this order. The Court appoints the U.S. Marshal to serve Defendant Dart. As a threshold inquiry, the Court anticipates having the parties further address Plaintiff's allegations of imminent physical harm.
