ORDER signed by the Honorable Virginia M. Kendall on 11/22/2021. Federal prisoner William Fuller has filed a 28 U.S.C. 2255 motion challenging his 2005 conviction from this Court. See United States v. Fuller, No. 04 CR 253-9 (N.D. Ill.) (Coar, J.). In 2016, Fuller filed a 2255 motion challenging his sentence from the same conviction, which this Court denied on the merits. See United States v. Fuller, No. 16 C 6586 (N.D. Ill.) (Kendall, J.). To bring another 2255 motion in this Court, Fuller must first obtain permission from the Seventh Circuit to file it. See 2255(h) ("A second or successive motion must be certified as provided in [28 U.S.C. ] 2244 by a panel of the appropriate court of appeals "); see also Seventh Circuit Rule 22.2. Whether Fuller satisfies the requirements of 2255(h) must be determined by the appellate court. Accordingly, Fuller's current 2255 motion is denied without prejudice to him refiling it after obtaining permission from the Seventh Circuit. All pending motions are also denied without prejudice.
