For the reasons stated in the Order, on screening review, the complaint #2 states a conditions-of-confinement claim as to Defendants Daly, Lamb, Rabideau, and Sherman. All other claims and Defendants are dismissed and shall be terminated by the Clerk. The Clerk of Court is directed to: (1) file Plaintiff's complaint #2 ; (2) issue summonses for service of the complaint on Defendants Daly, Lamb, Rabideau, and Sherman; (3) terminate the Illinois Department of Corrections, Warden Nicholson, and John Doe Plumbers SW, BM, and TS as Defendants; and (4) send Plaintiff four blank USM-285 service forms, filing instructions, and a copy of this order. In the original case, the Plaintiff had been granted leave to proceed in forma pauperis. See R. 5, Centeno v. Illinois Dep't of Corrs., No. 1:21-cv-3315 (N.D. Ill.) (Chang, J.). Therefore, the U.S. Marshal is appointed to serve Defendants and service may proceed at government expense. See Fed. R. Civ. P. 4(c)(3). The Court advises the Plaintiff that a completed USM-285 form for each Defendant is required for service. The U.S. Marshal will not attempt service on a Defendant unless and until the required form for that Defendant is received. The USM-285 forms must be returned by 01/24/2222. The Plaintiff's motion for attorney representation #4 is denied without prejudice. Filing 1 MINUTE entry before the Honorable Edmond E. Chang: The Court's previously advised the co-Plaintiffs that joint litigation can lead to logistical problems, so they have filed a motion to sever their lawsuit into two separate cases. R. 10. Their request 10 is granted. See Fed. R. Civ. P. 21 ("On motion or on its own, the court may at any time, on just terms, add or drop a party.") The Clerk is directed to administratively open a new case for Plaintiff Raul Dorado with the amended complaint 11 from this case and to place a copy of this order on the docket. The Clerk shall directly assign the newly opened case pursuant to Local Rule 40.4(b). Plaintiff Dorado shall continue in forma pauperis in the new case. Once a case number is assigned for Dorado's separate lawsuit, any payments towards the filing fee should identify the new case number. The Clerk of Court is directed to send a copy of this order to the trust fund officer at Stateville Correctional Center and to the Court's Fiscal Department. Dorado is terminated as co-plaintiff in this action and must proceed in his separate, individual lawsuit.
