MINUTE entry before the Honorable Marvin E. Aspen: After Plaintiff filed a complaint naming 216 defendants in a single case, we ordered Plaintiff to either show cause as to why the case should not be severed for misjoinder or file an amended complaint [Dkt. No. #25 ]. Plaintiff filed an Amended Complaint [Dkt. No. #26 ], but the Amended Complaint still names 31 defendants [Dkt. No. #27 ], and the allegations regarding joinder have remained unchanged. For the reasons provided in our prior opinion [Dkt. No. #25 ], these allegations are insufficient to support joinder. Accordingly, we will allow Plaintiff to proceed against only one of the 31 defendants. Plaintiff shall file a second amended complaint naming a single defendant by January 7, 2022. Furthermore, in light of the Amended Complaint and the anticipated second amended complaint, we deny Plaintiff's pending motion for a temporary restraining order ("TRO") and related relief [Dkt. No. #8 ] as moot, as the motion pertains to Plaintiff's original complaint, which is no longer the operative complaint in this litigation. If Plaintiff files a second amended complaint, it may file another motion for a TRO and related relief directed to the single defendant named in the second amended complaint. Plaintiff shall file any motion for a TRO and related relief by January 7, 2022 and email a proposed order for the motion to Judge Aspen's proposed order mailbox at Proposed_Order_Aspen@ilnd.uscourts.gov.
