ORDER: The Northern District of Georgia: (1) determined that this case, though titled a habeas corpus petition, is actually a civil action; and (2) transferred the case to this Court because the Defendants are in Chicago, Illinois. This Court agrees that this case is not a habeas petition. Federal pretrial detainee Kevin Burress (currently at the DeKalb County Jail in Alabama) filed this case against Akiane Kramarik, her art gallery, and others alleging that Burress "is an angel of the Lord," and "the Lord Jesus Christ... ordered that Akiane,... a prophet herself, be the marital spouse... of the Petitioner [and] fulfill her marital obligations without delay." Dkt. 1, pg. 1. Burress seeks a court order recognizing that his vision "is in fact the truth," and directing that he and Kramarik be in a courtroom together and provided "ample opportunity to fulfill the obligations of the marriage." Id. at 2. Burress does not seek release from custody, but instead declaratory and injunctive relief. Accordingly, the Clerk of this Court is directed to change the Nature of Suit to 550 (Prisoner Civil Rights). That said, the filing fee must be resolved before this case can proceed further. By January 11, 2022, Burress must either pay the $402 filing fee or submit a completed in forma pauperis application with a jail trust account statement. His failure to comply will result in summary dismissal of this case. The Clerk, in addition to changing the Nature of Suit, shall send Burress an IFP application with a copy of this order.
