Chang: On review of the Second Amended Complaint, R. 10, para. 3, the citizenship of ETrade Securities, LLC, is still not properly alleged, because the alleged sole member of that Defendant is itself an LLC (or so Paragraph 3 alleges). So the membership and the citizenship of ETrade Capital Management, LLC itself must be alleged. The Plaintiff must file a Third Amended Complaint by 01/28/2022. On review of the status reports, R. 17, 18, it is disappointing that the parties could not submit a joint report. In any event, by 01/21/2022, ETrade shall file a copy of the arbitration decision on this docket and a supplemental status report that states its citizenship for diversity purposes and also explains why it believes service of process was defective. The Court sets a phone status hearing for 02/07/2022 at 10:00 a.m. Members of the public and media will be able to call-in to listen to this hearing. The call-in number is (877) 336-1831 and the access code is 1736479. Counsel of record will receive an email before the start of the telephonic hearing with instructions to join the call. Persons granted remote access to proceedings are reminded of the general prohibition against photographing, recording, and rebroadcasting of court proceedings. The prior motion #5 is terminated as superseded by the amended motion. If the Plaintiff wishes to proceed with the case, then he must file a second amended complaint fixing the jurisdictional defects identified in the order, and also start service of process (or obtain a waiver). To track the case only (no appearance is required, the case will not be called), a status hearing is set for 01/21/2022 at 8:30 a.m. The parties shall file the joint initial status report by 01/14/2022. The parties must file a joint initial status report with the content described in the attached status report. Plaintiff must still file the report even if Defendants have not responded to requests to craft a joint report. If not all Defendants have been served, then Plaintiff must complete the part of the report on the progress of service. MINUTE entry before the Honorable Edmond E. Chang: On review of the complaint, the Court makes the following jurisdictional inquiry. Plaintiff Justin London premises jurisdiction on one basis, namely, diversity of citizenship, 28 U.S.C. 1332. R. 1, Compl., para. 4. London alleges that the citizenship of Defendant Etrade Securities, LLC is Virginia, because it has its principal place of business in Arlington, Virginia. R. 1 3. But an LLC's citizenship is not like a corporation's; instead, an LLC is a citizen of every state where its members are citizens. Wise v. Wachovia Securities, LLC, 450 F.3d 265, 267 (7th Cir. 2006). On or before 12/13/2021, London must either file an amended complaint fixing this jurisdictional defect or otherwise file a memorandum explaining why the current complaint sufficiently alleges jurisdiction.
