Filing 11 EXECUTIVE COMMITTEE ORDER: Case reassigned to the Honorable Ronald A. Guzman for all further proceedings. Honorable Andrea R. Wood no longer assigned to the case pursuant to IOP 13(f). Signed by Executive Committee on 1/31/22. (nsf, ) |
Filing 10 ORDER Signed by the Honorable Andrea R. Wood on 1/31/2022: Plaintiff's motion to recuse #8 , citing 28 U.S.C. 455(a), is granted. Plaintiff does not contend that the underlying facts of this lawsuit provide a basis for recusal. Rather, Plaintiff, who has been suspended from the practice of law on an interim and indefinite basis, seeks recusal on the grounds that this judge has been identified as a potential witness in ongoing disciplinary proceedings against him. See In re Felipe N. Gomez, S. Ct. Order of 04/08/2021 (imposing interim suspension). Specifically, Judge Wood presided over one of the cases (Case No. 19-cv-00540) in which Plaintiff's alleged misconduct occurred and thus has been identified as a person with knowledge of the facts by the Illinois Attorney Registration and Disciplinary Commission. Commission No. 2020-PR-00064, Administrator's Report Pursuant to Commission Rule 253 at para 4. The Court notes that Plaintiff recently filed a motion in another case before a different Judge in this District citing similar grounds. (See Case No. 21-cv-02619, Dkt. No. 5.) The motion was granted. (Id., Dkt. No. 6.) Out of an abundance of caution, the Court similarly grants Plaintiff's motion here. The case will be reassigned by random lot. Mailed notice (dal, ) |
Filing 9 MINUTE entry before the Honorable Andrea R. Wood: Plaintiff has filed a motion for recusal and for resetting of 1.25.22 status #8 . The request for recusal is taken under advisement for ruling. Mailed notice (dal, ) |
