| Filing 6 MINUTE entry before the Honorable Steven C. Seeger: The Court reviewed the motion to enforce a subpoena in this miscellaneous action. The subpoena involves the deposition of a third party, Mr. Petro. Petro's response to the motion is due by January 7, 2022. Bay Tek can respond to the motion by January 7, 2022 as well (if it chooses to do so). Petro must identify with particularity any dates when he would be unavailable for deposition in January 2022. For any avowed unavailability, Petro must offer a compelling reason with specificity. If Bay Tek is unavailable on specific dates, then Bay Tek must identify them in the same fashion. If Petro is aware of any case law standing for the proposition that a deposition of a third party cannot go forward unless and until the third party receives documents, then Petro must identify that authority for this Court. The Court has not yet heard from both sides, so it will keep an open mind until it hears the full story. But in the meantime, the parties and Mr. Petro should know that the Court has little patience for anyone who fails to participate in good faith in the scheduling of depositions. Scheduling depositions should be a ministerial exercise if counsel act in good faith. A failure to respond to repeated requests for dates, last-minute cancellations, and other shenanigans obstruct the smooth operation of discovery, and thus interfere with the truth-seeking function of litigation. So, the Court encourages the parties and Mr. Petro to attempt in good faith to resolve the dispute next week if at all possible. Otherwise, the Court will take it up. Mailed notice. (jjr, ) |
