Filing 6 ORDER: Petitioner Sherman Jilton seeks to bring a 28 U.S.C 2241 petition asserting a speedy-trial claim and claiming confinement as a pretrial detainee for over eight years without a trial. The Court denies his motion to proceed in forma pauperis (IFP) #3 , as his prison trust account statement shows he has a current balance of $139.00 and has received more than $150 each month during the six-month period before filing this case. Such funds render him ineligible for pauper status. See Longbehn v. United States, 169 F.3d 1082, 108384 (7th Cir. 1999) (citing Lumbert v. Illinois Dep't of Corr., 827 F.2d 257, 260 (7th Cir. 1987)). He must pay the $5.00 filing fee to proceed with this case, which he may do by check or money order made payable to Clerk, United States District Court Northern District of Illinois. If Petitioner fails to comply with this order by February 4, 2022, the Court will summarily dismiss this case without prejudice. See N.D. Ill. Local Rule 3.3(f). The Court denies without prejudice Petitioner's motion for an attorney #4 . Courts recruit counsel in habeas corpus cases for evidentiary hearings or if justice so requires, see Rule 8(c) of the Rules Governing 28 U.S.C. 2254 Cases, and typically cannot make such determinations until after a response to the habeas petition has been filed.
