While Defendants do not object to consolidation, Plaintiff Daly states that he objects to full consolidation due to Plaintiff Ulery's "unique" position as a former high-ranking executive and former board member at West Monroe Partners, Inc., who may have had access to information relevant to the claims alleged in these two actions and also may have participated in fiduciary decisions at issue. Plaintiff Daly does not oppose the filing of an amended complaint covering all claims as to both named plaintiffs, nor does he object to consolidated discovery. Plaintiff Daly contends, however, that Plaintiff Ulery's "apparent" conflict of interest and atypicality make him unlikely to act as an appropriate class representative and could create confusion at a joint trial. Neither Plaintiff Ulery nor Plaintiff Daly made the Court aware of the possibility of a significant conflict of interest when the motion to reassign was presented to the Court.
