ORDER : It appears the Clerk erroneously filed the pleading in this case as a 28 U.S.C. 2241 habeas corpus petition. It is a 28 U.S.C. 2255 motion. The Clerk is requested to: (1) file Docket Entry One as a 28 U.S.C. 2255 motion; (2) update the docket to reflect that the Cause is 28:2255 and Nature of Suit is 510 Prisoner: Vacate Sentence; (3) reflect that United States of America is Plaintiff and David Conrad is Defendant-Movant; and, (4) alter the case caption to United States v. Conrad. As to Mr. Conrad's 2255 motion, the case is dismissed for want of subject matter jurisdiction as an unauthorized second or successive 28 U.S.C. 2255 motion, 28 U.S.C. 2255(h). The Court declines to issue a certificate of appealability. The Clerk shall enter a Rule 58 Judgment in favor of the United States of America and against Conrad. Civil case closed.
