Kennelly: The applicants in this case have filed an ex parte application under 28 USC 1782 seeking permission to serve subpoenas for records and testimony in aid of a civil proceeding pending in the Netherlands. Their only support for doing this ex parte - that is, without letting the opposing litigant know (or, for that matter, the proposed subpoena respondent)- is their contention that such applications are "regularly" granted ex parte. Their citations for this, however, are non-binding and sparse. The Court does not believe they have overcome the general presumption against ex parte proceedings.
