March 1, 2022 Opinion or Order Filing 19 ORDER: Plaintiff Larry Bruce Rubin brings this pro se action under the Electronic Funds Transfer Act, 15 U.S.C. 1693, et seq. Before the Court is Plaintiff's renewed motion for attorney representation. R. #15 , Mot. Rep. Plaintiff's motion for attorney representation #15 is granted. Plaintiff also filed what appears to be a duplicate renewed motion for attorney representation #17 , which is denied as moot. The Court enlists Mark Steven Smith with Engelman & Smith, 1603 Orrington Ave., Ste. 800, Evanston, Illinois 60201-3872, mark@engelmanandsmith.com to represent Plaintiff in accordance with counsel's trial bar obligations under N.D. Ill. Local Rules 83.11(h) and 83.37. By March 22, 2022, counsel should enter an appearance for Plaintiff. By May 2, 2022, Mr. Smith shall inform the Court whether he intends to proceed with Plaintiff's Complaint or submit an amended complaint. The Court encourages Mr. Smith to visit the Pro Bono Resources for Trial Bar Attorneys now available on the Court's homepage for various resources related to pro bono representation. January 24, 2022 Opinion or Order Filing 10 ORDER: Plaintiff Larry Bruce Rubin's application for leave to proceed in forma pauperis #7 is granted. Because Plaintiff has been authorized to proceed in forma pauperis, pursuant to Federal Rule of Civil Procedure 4(c)(3), the Court orders the United States Marshal's office to serve Defendants. The USM-285 form has already been submitted 3 . The Marshal is authorized to mail a request for waiver of service to Defendant in the manner prescribed by Fed. R. Civ. P. 4(d)(2) before attempting personal service. Plaintiff's motion for attorney representation #8 is denied without prejudice. In his motion, Plaintiff checked the box stating "I have not previously been represented by an attorney requested by the Court in any federal criminal or civil case." R. #8 3 (emphasis in original). However, based on the Court's review of the Northern District of Illinois dockets, it appears that Plaintiff has been previously represented by counsel recruited by the Court.
