Filing 14 ORDER: Plaintiff filed a letter #13 informing the court that he is determined the names of the persons involved in his case and is prepared to amend his complaint to name those officers as Defendants. The court construes this letter as a motion for leave to submit an amended complaint, and grants it. By April 1, 2022, Plaintiff shall submit his amended complaint. He his reminded, however, that any amended complaint must be signed and submitted on the Court's required form. See FED. R. CIV. P. 11(a); Local Rule 81.1. Plaintiff must write both the case number and the judge's name on the amended complaint, sign it, and return it to the Prisoner Correspondent. Plaintiff is cautioned that an amended pleading supersedes the original complaint and must stand complete on its own. Therefore, all allegations must be set forth in the amended complaint without reference to the prior complaint. Any exhibits Plaintiff wants the court to consider in its threshold review of the amended complaint should be attached, as well. Plaintiff is advised to keep a copy for his files. Filing 12 ORDER: The court construes Plaintiff's motion #11 as a motion to compel the release of the arrest report of the underlying arrest that gave rise to this 1983 action. As no Defendant has been served, however, Plaintiff's motion #11 is denied without prejudice as premature. Plaintiff is reminded that once Defendant Brown has been served and an appearance for defense counsel has been entered, Plaintiff should then serve defense counsel a list of questions eliciting information regarding the identities of the unknown officers, as discussed in the court's initial screening order. In light of Plaintiff's recent transfer to Pinckneyville Correctional Center, the Court directs the Clerk of Court to re-mail to Plaintiff Dkt. #7 and a blank USM-285 form, and to send a copy of Dkt. #7 to the trust fund officer at Pinckneyville Correctional Center. Filing 7 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The court orders the trust fund officer at Plaintiff's place of incarceration to deduct $30 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. Plaintiff's trust fund officer must collect 20% of all income into his trust account until accrued filing fees are paid. The court directs the Clerk to: (1) forward copies of this order to the Fiscal Department, and to the trust account office at Plaintiff's place of confinement; (2) file Plaintiff's complaint #1 ; (3) add Police Superintendent David O'Neal Brown as a Defendant; (4) issue summons for service on Defendant Brown; and 5) mail Plaintiff one blank USM-285 service form, filing instructions, and a copy of this order. The court appoints the U.S. Marshal to serve Defendant. The court advises Plaintiff that a completed USM-285 form is required for service on Defendant. Plaintiff must fill out and return the required service form or this case may be dismissed for failure to prosecute. The U.S. Marshal will not attempt service on Defendant unless and until the required form for Defendant is received. Once he has served Defendant Brown, and the Defendant has been served and appeared, Plaintiff can send defense counsel interrogatories a list of questions eliciting information regarding the identities of the unknown officers. Plaintiff can then submit a proposed amended complaint naming the proper Defendants. Plaintiff's motion for attorney representation #4 is denied without prejudice. Signed by the Honorable Rebecca R.
