Date Filed Document Text
February 28, 2022 Opinion or Order Filing 8 ORDER: The Court denies Plaintiff's applications for leave to proceed in forma pauperis #3 #5 without prejudice. Plaintiff must: (1) file a properly supported amended in forma pauperis application with the information specified in the "Statement" section of this order; and (2) submit a memorandum explaining why given his income, he failed to save funds sufficient to pay the filing fee. Alternatively, Plaintiff may prepay the $402 filing fee. If Plaintiff does not comply by March 21, 2022, the Court will summarily dismiss this case. Plaintiff's motion for attorney representation #4 is denied without prejudice as writing to one law firm and one attorney, who purportedly told him that they are "overwhelmed with cases due to cov-19," does not show that he made a reasonable effort to locate his own attorney, see Eagan v. Dempsey, 987 F.3d 667 (7th Cir. 2021). In addition, nothing suggests that he cannot address his fee status on his own. Plaintiff must promptly update his address each time it changes while this case is open. If he fails to do so, this case will be subject to dismissal with no further warning. Finally, Plaintiff initiated this lawsuit using the name Rahshard Saulsberry and is being prosecuted in state court using this name. However, he is in custody at the Cook County Jail under the name Rahshard Saulberry. The discrepancy has already caused mail problems #6 #7 . The Clerk is directed to: (1) update the docket to list Plaintiff's name as "Rahshard Saulsberry a/k/a Rahshard Saulberry (#2021-0904066)"; (2) make the necessary updates so mailing labels print with this name; and (3) send an in forma pauperis application for persons in custody, as well as a copy of this order, to Plaintiff. Signed by the Honorable Mary M. Rowland on 2/28/2022. Mailed notice (nsf, )
