Date Filed Document Text
February 10, 2022 Filing 9 COMPLAINT filed by Felix Anderson, Jr. (ph, )
February 10, 2022 Opinion or Order Filing 8 ORDER: Plaintiff's in forma pauperis application #4 is granted and he is excused from paying the filing fee. Plaintiff's motion for attorney representation #7 is denied without prejudice (meaning that the plaintiff can file another motion that addresses the problems described here). There is no right to counsel in ordinary civil proceedings. In considering requests for recruited counsel, a court asks whether 1) the plaintiff has made reasonable attempts to retain counsel before enlisting the court's assistance, and 2) whether the case is too difficult for a plaintiff to litigate by himself. Pruitt v. Mote, 503 F.3d 647, 653 (7th Cir. 2007). Mr. Anderson states that he has not retained a lawyer because he cannot afford one, but he has not attempted to contact any legal aid clinics that serve indigent clients. If Mr. Anderson moves for counsel again, he should detail which organizations he has contacted. Moreover, Mr. Anderson did not check any box to indicate his education level or explain why he is unable to proceed at this early stage of the litigation on his own; this information is important for the Court to decide whether the plaintiff is competent to litigate the case himself. Signed by the Honorable John J. Tharp, Jr on 2/10/2022. Mailed notice (ph, )
