Filing 6 MINUTE entry before the Honorable Gary Feinerman:Plaintiffs have not responded to the 2/4/2022 show cause order #5 . Accordingly, this case is dismissed for want of subject matter jurisdiction. Enter judgment order. The status hearing set for 3/11/2022 #5 is stricken. Civil case closed.Mailed notice. (jlj, ) |
Filing 5 MINUTE entry before the Honorable Gary Feinerman:Motion for leave to proceed in forma pauperis #4 granted in part and denied in part without prejudice. Plaintiffs may proceed in forma pauperis. Plaintiffs' request for attorney representation is denied without prejudice as premature. See Pickett v. CTA, 930 F.3d 869, 871 (7th Cir. 2019); Romanelli v. Suliene, 615 F.3d 847, 852 (7th Cir. 2010). On the court's own motion, Plaintiff is ordered to show cause in writing by 2/25/2022 why this case should not be dismissed for want of subject matter jurisdiction. The complaint asserts only state law claims, so the only basis for jurisdiction is diversity, 28 U.S.C. 1332(a). However, the complaint does not allege the citizenship of any party. (To properly allege the citizenship of an LLC, the party invoking federal jurisdiction must identify all members of the LLC and the citizenship of each member. See West v. Louisville Gas & Elec. Co., 951 F.3d 827, 829-30 (7th Cir. 2020); Thomas v. Guardsmark, LLC, 487 F.3d 531, 534 (7th Cir. 2007).) Plaintiff may discharge this order by filing a Jurisdictional Addendum that properly alleges the citizenship of all parties. If Plaintiff fails to do by 2/25/2022, this case will be dismissed for want of subject matter jurisdiction. Status hearing set for 3/11/2022 at 9:15 a.m. Attorneys/Parties should appear for the hearing by calling the Toll-Free Number: (877) 336-1828, Access Code: 4082461. Members of the public and media will be able to call in to listen to this hearing (use toll free number). Please, please be sure to keep your phone on mute when you are not speaking. Persons granted remote access to proceedings are reminded of the general prohibition against photographing, recording, and rebroadcasting of court proceedings. Violation of these prohibitions may result in sanctions, including removal of court issued media credentials, restricted entry to future hearings, denial of entry to future hearings, or any other sanctions deemed necessary by the Court. Mailed notice. (jlj, ) |
