Filing 18 MINUTE entry before the Honorable Joan B. Gottschall: By order #6 dated 2/9/2022, this court gave defendant until 2/23/2022 to amend its notice of removal in order to allege adequately the citizenship for diversity jurisdiction purposes of the three limited liability companies named as parties. The deadline has come and gone, and no amended notice of removal has been filed. The parties filed separate LR 3.2 notifications of affiliates (Nos. #14 , #15 , and #16 ) on 2/25/2022, and defendant filed its answer #17 to the state court complaint on 2/28/2022. Although the notifications of affiliates identify the LLCs' individual members, they do not allege the individual members' citizenship, that is, the state in which each is domiciled. Nor does the citizenship of AGI-CFI Acquisition Corp. (the sole member of plaintiff Maestro International Cargo LLC) appear in the record. Because defendant has failed to allege adequately the basis for this court's exercise of diversity jurisdiction under 28 U.S.C. 1332(a), this case is remanded to the Circuit Court of Cook County, Illinois, under 28 U.S.C. 1447(c) for lack of subject matter jurisdiction. Civil case terminated. Mailed notice (mjc, ) |
