Filing 6 ORDER Signed by the Honorable Andrea R. Wood on 4/7/2022: Plaintiff's application for leave to proceed in forma pauperis #4 is denied without prejudice because the application is incomplete. Specifically, in Question (4), Plaintiff indicates that he does have money in cash or in a checking or savings account but answers "Unknown" as to the amount. However, because Plaintiff answered Question (4) in the affirmative, he is required to ascertain the amount of funds he has in cash or in bank accounts and provide a specific figure in response to Question (4). As a result of this omission, the Court does not have sufficient information from which to make a determination regarding Plaintiff's ability to pay the fees and costs associated with this lawsuit. Further, based on the Court's review pursuant to 28 U.S.C. 1915(e), Plaintiff's complaint is dismissed without prejudice. To proceed with this action, Plaintiff shall submit, by 4/28/2022, the following: (1) a renewed, complete application for leave to proceed in forma pauperis, or, alternatively, payment of the full $402 filing fee; and (2) an amended complaint that states a viable claim for relief. If Plaintiff fails to make the required submissions by 2/28/2022, the Court will assume that Plaintiff no longer desires to proceed with this action and the case will be closed. See the accompanying Statement for details. Mailed notice (dal, ) |
