MINUTE entry before the Honorable Mary M. Rowland: The court has reviewed the joint initial status report. Plaintiffs' responses to motions to dismiss are extended to 7/20/22. Defendants' replies are due 8/10/22. The parties are to submit a proposed protective order to [email protected] by 7/20/22. The Court is curious about two statements in the status report. First, plaintiffs' take the position that if "Defendants' motions to dismiss are denied" full discovery should begin on 7/8/22. #51 at 4. Plaintiffs should not expect a ruling on the pending motions to dismiss by July 8, 2022. Second, Defendants inform the court that they intend to file "subsequent motions to dismiss". With arguments made pursuant to FRCP 12(b)(1) and 12(b)(6) and 45 pages of briefing submitted thusfar, the court wonders what remains to be said. The status report indicates counsel are discussing agreeing to limited discovery of documents with a stay of oral and other written discovery pending a ruling. The case is set for telephonic status on 8/24/22 at 9:30 AM. Parties should call 866-434-5269; access code 3751971.
