Filing 25 MINUTE entry before the Honorable Franklin U. Valderrama: Three matters are currently before the Court. First, in its motion for extension of time to file joint initial status report #21 , Plaintiff informed the Court that Defendant Jason Tomlinson (Tomlinson) had filed a voluntary petition for relief under chapter 7 of title 11 of the United States Code (the "Bankruptcy Code") in the United States Bankruptcy Court for the District of South Carolina. According to the public docket, that case number is 22-01272-dd. Therefore, all proceedings in this Court as to Defendant Tomlinson are stayed pursuant to 11 U.S.C. 362. Second, the Court grants Plaintiff's motion for entry of default against Defendant Garrett Mann (Mann) #22 . Default is entered against Mann under Federal Rule of Civil Procedure 55(a). The Court directs Plaintiff to mail a copy of this minute entry to Mann at his service address no later than 6/13/2022 via USPS First Class Mail or a similar mailing service. By 7/7/2022, Plaintiff shall file a motion for default judgment pursuant to Federal Rule of Civil Procedure 55(b). Third, the Court has reviewed Plaintiff's Motion for Default Judgment against Defendant Safe Harvest Medical, LLC #23 . The Court denies the motion without prejudice the motion lacks any documentary evidence in support of the request for attorneys' fees and costs. For amounts requested through default judgment, including attorneys' fees, proof such as billing records or invoices shall be filed with the motion for default judgment. See e360 Insight, Inc. v. The Spamhaus Project, 500 F.3d 594, 602 (7th Cir. 2007) ("Under the law of this circuit, judgment by default may not be entered without a hearing on damages unless the amount claimed is liquidated or capable of ascertainment from definite figures contained in the documentary evidence or in detailed affidavits.") (citing and quoting Dundee Cement Co. v. Howard Pipe & Concrete Prods., Inc., 722 F.2d 1319, 1323 (7th Cir. 1983)); see also Douglas v. Keen, 2007 WL 2915586, at *2 (S.D. Ill. Oct. 5, 2007), supplemented, 2007 WL 3120111 (S.D. Ill. Oct. 23, 2007). Any renewed motion should include documentary evidence regarding Plaintiff's costs and attorney's fees. Mailed notice (axc). |
