Shah: The court adopts the parties' case management order, [32-1], to the extent it is agreed and except as follows: Trial will begin on 10/4/22 and the court will set aside 10/4/22 through 10/14/22 for trial. The court is scheduled to preside over a criminal jury trial starting 10/17/22, so the presentation of evidence in this case must conclude by 10/14/22. As the trial date approaches, the court will discuss moving the start date to 10/3/22, as well as the daily schedule of in-court time, with the parties. Each side shall exchange a preliminary list of trial witnesses (including experts) by 5/31/22. Each side is limited to 20 witnesses (excluding experts). Each side shall exchange final trial witness lists on 7/15/22. Each side is limited to 20 witnesses (excluding experts) on the final list, and may disclose no more than 5 witnesses not previously disclosed in the preliminary list. A party may move to bar a new witness based on a showing that the disclosure was an unfair surprise or if not enough time remains to adequately depose the new witness. Initial expert reports shall be simultaneously disclosed 8/12/22, and all fact discovery must be completed by 8/15/22. Rebuttal expert reports are due 8/25/22. The court will consider whether to allow reply expert reports after the parties exchange their first round of reports. Initial exhibit and deposition designations shall be exchanged 9/6/22, and objections and counter-designations shall be exchanged 9/9/22. Notice to non-parties of the designation of their documents and witness deposition designations is due 9/9/22. All parties shall complete their efforts to confer over exhibits, deposition designations (including counter-counter-designations), and confidentiality, including with non-parties, by 9/14/22. Expert discovery closes 9/16/22. Evidentiary motions in limine (no more than 3 per party), substantive motions to narrow issues for trial (1 per party), and any trial briefs (effectively opening statements, 1 per party) are due 9/22/22. All briefs are limited to 15 pages each. Any briefs in opposition to pretrial motions are due 9/26/22. Also on 9/26/22, the parties shall file a joint statement outlining disputes over exhibits, depositions, and confidentiality.
