Filing 7 ORDER: Plaintiff Darlene Reed, pro se, seeks permission to proceed in forma pauperis ("IFP") in this lawsuit against her former employer, seeking damages arising out of her termination following a criminal background check. Because plaintiff does not have sufficient assets to pay the costs of suit without impinging on her ability to pay for "the necessities of life," see Adkins v. E.I. Dupont de Nemours & Co., 335 U.S. 331, 339 (1948), her IFP application #4 is granted. Further, her complaint passes this Court's initial screening, see 28 U.S.C. 1915(e)(2)(B)(ii), because it is not frivolous and, under the lenient pleading standards for pro se litigants, she states at least an arguable claim for relief under the Fair Credit Reporting Act, 15 U.S.C. 1681 et seq. See id. 1681b(b)(3)(A), 1681n, 1681o; see also Beverly v. Wal-Mart Stores, Inc., No. 07CV469, 2008 WL 149032, at *3-4 (E.D. Va. Jan. 11, 2008); cf. Dahy v. FedEx Ground Package Sys., Inc., No. CV 17-1633, 2018 WL 4328003, at *10 (W.D. Pa. Aug. 3, 2018); see generally National Consumer Law Center, Fair Credit Reporting, 8.11.3, Pre-Adverse Action Notices. The Court instructs the Clerk to issue summons for service of the complaint on defendant, and appoints the United States Marshals Service to effect service. The Marshal is authorized to mail a request for waiver of service to the defendants in the manner prescribed by Fed. R. Civ. P. 4(d)(2) before attempting personal service.
