Filing 7 MINUTE entry before the Honorable Harry D. Leinenweber: Plaintiff's motion to withdraw complaint #6 is granted. This matter having been settled the claims are withdrawn with prejudice. The Court is unable to refund Mr. Johnson's filing fee pursuant to General Order 160-0020 which only provides for a refund if erroneous or duplicate payments are made. According to the Seventh Circuit, "There is no refund of a filing fee just because an appellant, petitioner, or other seeker of judicial review is dissatisfied with the outcome of his quest, whether that outcome is defeat on the merits or a refusal, for jurisdictional or other reasons, even to consider the merits."
