Filing 10 ORDER: For the reasons explained below, Spencer Edward Leifheit, III's application for leave to proceed in forma pauperis #4 and motion for attorney representation #5 are denied without prejudice. In addition, Plaintiff's complaint #1 is dismissed without prejudice for failure to adequately allege this court's jurisdiction over this case (and even if the court had jurisdiction, for failure to state a claim). If Plaintiff wishes to proceed with this lawsuit, he must submit an amended complaint consistent with this order. Failure to submit an amended complaint by June 17, 2022, will result in summary dismissal of this case. The Clerk is directed to correct the docket and case caption to reflect that Stacey Lee Heinrich is no longer an active plaintiff and to send Plaintiff a copy of this order, an amended complaint form, a blank in forma pauperis form, a blank USM-285 form, and instructions. Plaintiff must promptly submit a change-of-address notification if he moves, or this action may be subject to dismissal for failure to comply with a court order and failure to prosecute. Signed by the Honorable Martha M. Pacold on 5/27/2022. Mailed notice. (jmk, ) |
