It nevertheless appears from the complaint that this case is filed as a potential tagalong action to In Re: Abbott Laboratories, et al., Preterm Infant Nutrition Products Liability Litigation, No. 22-cv-71 (MDL No. 3026). Local Rule 40.3(b)(6) requires direct assignment of a potential tagalong action to the judge presiding over an MDL. Under Internal Operating Procedure 11(b), "Whenever it appears that a case has been assigned by lot that should have been assigned directly under the provisions of this section, the judge receiving the case shall transfer it to the Executive Committee for reassignment to the calendar of the judge to whom it should have been assigned directly."
