The Court adopts the proposed schedule, with one change. Fact discovery will close by December 19, 2022. (The Court is setting the deadline before the holidays, in an act of mercy.) Scheduling Order to follow. Plaintiff has not made a settlement demand. Plaintiff must make a written settlement demand in good faith by June 10, 2022. Defendant must respond in writing and in good faith by June 30, 2022. The parties must meet and confer, and must file a statement by July 11, 2022 addressing whether there is a joint request for a settlement conference. In the joint status report, Defendant took the position that a substantial portion of Plaintiff's complaint is time barred. The parties must address that issue in their letters to each other, explaining their positions in detail. And the parties must discuss this issue before filing the statement with the Court. The Court directs the parties to consider the risks of litigation, including the likelihood or unlikelihood of success on the merits. In that filing, the parties must address whether some or all of Plaintiff's claims are barred by Dr. Shott's "second lawsuit against Rush." Id. at 3.
