Filing 53 SEALED MOTION by Plaintiffs Jorel Shophar, Raphah Shophar (exr, ) |
Filing 52 SUMMONS Returned Executed by plaintiffs as to Paul Lafleur on 6/24/2022, answer due 7/15/2022. (gcy, ) |
Filing 51 MINUTE entry before the Honorable Franklin U. Valderrama: Before the Court is Plaintiffs' motion for leave to file convention evidence under seal #50 , in which Plaintiffs request that the Court allow them to file under seal a video of a hearing in Kansas among the parties as part of the initial status report due 7/18/2022. Plaintiffs' motion #50 is denied, as the joint initial status report is not the appropriate filing to include such evidence. The Court again directs Plaintiffs' attention to the U.S. District Court Hibbler Memorial Pro Se Assistance Program, information about which can be found at: https://www.ilnd.uscourts.gov/Pages.aspx?/2+UWDbtVzCDq3Lu8BusuQ== or 312-435-5691. The Court also reminds Plaintiffs that, before filing any motion, they must ask counsel for any defendant that has appeared in the action whether they have an objection to the motion. As the Court previously informed Plaintiffs, any motion filed before the Court must indicate in the title and body of the motion whether the motion is opposed or unopposed #42 . Additionally, for the reasons stated in the motion, Defendant Cornerstones of Care's motion for extension of time to answer or otherwise plead #49 is granted. Defendant Cornerstones of Care's answer or other responsive pleading is due by 7/21/2022. However, the Court notes that simply because Plaintiffs are pro se does not excuse any defendant from complying with the Court's requirement that they consult with Plaintiffs as to whether Plaintiffs object to the filing of any motion. The Court expects all parties to comply with its standing orders, including the conferral requirement. Mailed notice. (kp, ) |

Valderrama: The briefing schedule on Defendant Pathway Family Services, LLC's motion to dismiss for lack of jurisdiction entered on 6/21/2022 #43 is stricken, since the motion was terminated as moot #42 . Defendant Pathway Family Services, LLC's responsive pleading to Plaintiffs' amended complaint is due by 7/7/2022. Mailed notice (axc). |
Filing 48 AMENDED complaint by Jorel Shophar, Raphah Shophar against Cornerstone of care - Gillis Campos, Johnson County, Kansas Board of Commissioners, KVC Health, KVC Niles, Richard Klein, Erica Miller, Pathway Family Services LLC, Kathleen Sloan, Paul Lafleur, Krissy Gorski (rp, ) |
Filing 43 MINUTE entry before the Honorable Franklin U. Valderrama: The Court sets the following briefing schedule on Defendant Pathway Family Services, Llc's Motion to Dismiss #39 as follows: Plaintiff's response due on or before 07/12/2022; Defendant Pathway Family Services, Llc's reply due on or before 07/26/2022. Additionally, the Court grants Attorney Erin Pauley's Motion for Withdrawal and Substitution of Lead Counsel #41 . Attorney Erin Pauley is withdrawn as counsel for Defendants KVC Health and KVC Niles. Attorney David Arthur Boresi is granted leave to file an appearance on behalf of Defendants KVC Health and KVC Niles. Mailed notice (axc). |
Filing 42 MINUTE entry before the Honorable Franklin U. Valderrama: Plaintiffs' motions for attorney representation #5 , #6 are denied without prejudice. There is no right to counsel in civil cases. Olson v. Morgan, 750 F.3d 708, 711 (7th Cir. 2014). Although plaintiffs have tried to find counsel on their own, Plaintiff Jorel Sopher has some college education, and Plaintiff Raphah Shophar is a high school graduate, and this case is in its earliest stages. Plaintiffs appear capable at this point of litigating the matter without an attorney. If the case gets to a stage that is too complicated to manage, plaintiffs can renew their requests. The Court grants Plaintiffs' motion for leave to file an amended complaint #27 and the Amended Complaint #28 will be the operative Complaint in this case. The Court notes, however, that Plaintiffs failed to indicate in the title and the body of the motion whether the motion is opposed or unopposed. Pursuant to the Court's Standing Order, "[b]efore filing a motion, the movant's counsel must ask opposing counsel whether there is an objection to the motion. Whether the motion is opposed or unopposed should be so identified in the title and body of the motion." Because Plaintiffs are pro se, the Court excuses the requirement this one time, but advises Plaintiff that, when filing motions in the future, they must contact Defendants' counsel to ask if they oppose the motion or not. The Court directs Plaintiffs' attention to the U.S. District Court Hibbler Memorial Pro Se Assistance Program, information about which can be found at: https://www.ilnd.uscourts.gov/Pages.aspx?/2+UWDbtVzCDq3Lu8BusuQ== or 312-435-5691. Defendant Pathway Family Services, LLC's motion to dismiss for lack of jurisdiction #39 is terminated as moot. All served Defendants' responsive pleadings are due by 7/7/2022. The joint initial status report remains due on 7/18/2022. Mailed notice (axc). |
