Chang: On review of the motion #66 for sanctions filed by Peter Mallouk, Creative Planning LLC, Creative Planning Holdco, LLC, CPI Holdco A LLC, CPI Holdco B LLC, General Atlantic Service Company LP, and General Atlantic (CP) Collections LP, for now the motion is terminated without prejudice. This motion is intertwined with the pending litigation over the dismissal motion. It makes little sense to multiply the briefs on the issue until a decision on the dismissal motion is issued; the decision might moot the sanctions motion or make it less likely to be brought, or (conversely) provide the sanctions request with solid footing. So the motion is terminated without prejudice, and whatever shot-across-the-bow strategy has been accomplished. Emailed notice (mw, )

August 9, 2022 Filing 42 MINUTE entry before the Honorable Edmond E. Chang: Although the agreed extension and page-expansion motion #41 is granted, the Court sets the following parameters on the briefing. The answer or response deadline (which presumably will be dismissal motions) is extended to 09/06/2022, as is the 75-page collective defense expansion request. The Court appreciates the coordination efforts on both sides, but imposes the following for the sake of more efficient judicial review: the Defendants shall file one motion to dismiss; the Defendants shall file a joint memorandum presenting jointly made arguments; and the Defendants may file separate memoranda on a per-Defendant basis (or per-sets-of-Defendants basis) for separately made arguments. The joint and separate memoranda may add up to 75 pages. The purpose of this structure is to avoid repetitive briefing (like setting forth the factual allegations multiple times or presenting overlapping arguments multiple times). If this structure requires additional time beyond 09/06/2022, the defense may file a concise motion asking for it. The Plaintiffs' response to the dismissal motions is due on 11/01/2022 and shall be filed in a single, combined brief of no more than 40 pages (as requested). The single response brief of course should address both the jointly made and individually made defense arguments, and if feasible, the Court would appreciate PDF bookmarks for the separate subsections of the brief. The defense replies are due on 12/01/2022, again taking the form of a joint reply and individual replies, consuming a total of 30 pages (even better would be a single reply brief with bookmarked individual sections). The tracking status hearing of 08/26/2022 is reset to 09/23/2022, but to track the case only (no appearance is required, the case will not be called). Instead, the parties shall file the joint initial status report by 09/16/2022. The Court assumes that discovery will be paused during pendency of dismissal motions, so there is no need to fill out that part of the initial status report. Mailed notice. (jjr, )
