Filing 10 MINUTE entry before the Honorable Heather K. McShain: This case has been reassigned to Magistrate Judge McShain based on the parties' consent #8 , #9 . The Court has reviewed the parties' initial joint status report #7 . The Court will adopt the parties' proposed schedule for fact discovery with a few modifications. First, the Court will not adopt the parties' proposed MIDP date, as that project concluded on 06/01/2020 and cases filed after that date are not governed by the MIDP. Second, the Court notes that the typical sequence of discovery is for Rule 26(a)(1) disclosures to be issued before the parties issue their initial written discovery requests, thus the Court has swapped those deadlines. Fact discovery will therefore proceed as follows: Initial Rule 26(a)(1) disclosures due 07/29/2022; initial written discovery to be issued by 08/12/2022; all fact discovery to be noticed in time to be completed by 11/25/2022. The Court will defer setting an expert discovery and dispositive motion schedule until closer to the completion of fact discovery. By 08/15/2022, the parties shall file a joint status report to update the Court on: (a) the status of written discover; (b) the state of settlement discussions, if any; and (c) any other matters the parties wish to bring to the Court's attention.
