July 22, 2022 Filing 6 MINUTE entry before the Honorable John J. Tharp, Jr: The plaintiff's application to proceed in forma pauperis is granted and the plaintiff may proceed without prepaying the filing fee. Upon review of the complaint pursuant to 28 U.S.C. 1915(e), however, the Court dismisses it without prejudice for lack of subject matter jurisdiction. The complaint alleges that the defendant violated the Illinois Biometric Information Privacy Act by collecting the plaintiff's fingerprint. This claim arises under state law, and thus the only possible source of federal jurisdiction is diversity of citizenship between the parties. 28 U.S.C. 1332. The plaintiff has not alleged that he and the defendant are citizens of diverse states, in fact, he has not alleged the parties' respective citizenship at all. Nor has he alleged any facts to support his demand for the jurisdictional amount in controversy of $75,000. The complaint does not set forth a basis for federal subject matter jurisdiction; accordingly, it is dismissed without prejudice. Williams may file an amended complaint by 8/22/22 that sets forth a basis for federal jurisdiction. Failure to do so will result in summary dismissal of this case. Mailed notice (cn).
