Filing 10 ORDER: The Court grants Plaintiff's application to proceed in forma pauperis #7 and authorizes the trust fund officer at Plaintiff's place of incarceration to deduct $8.40 from Plaintiff's account as the initial partial payment of the filing fee and to continue making deductions in accordance with this order as set forth below (40% of Plaintiff's income, when it meets statutory minimums, must be devoted toward his filing fees). The Court directs the Clerk to: (1) send a copy of this order of the facility having custody of Plaintiff (electronically if possible) and to the Court's Fiscal Department. However, summonses shall not issue at this time. Plaintiff's complaint #1 and amended complaint #6 are dismissed for failure to state a claim. If Plaintiff wishes to pursue this case, by August 22, 2022, Plaintiff must submit: (1) a second amended complaint; consistent with this Order and (2) a separate completed USM-285 service form for each Defendant named in the second amended complaint. If he fails to submit those items by that date, the Court will summarily dismiss this case for failure to state a claim on which relief may be granted. The Clerk is directed to send a copy of this order to Plaintiff, along with an amended civil rights complaint form, and three (3) blank USM-285 (Marshals Service) forms. Filing 5 ORDER: The Court denies Plaintiff's application to proceed in forma pauperis #3 without prejudice. If Plaintiff wants to proceed with this lawsuit, he must either (1) submit a renewed application signed by Plaintiff, certified by an appropriate official, and accompanied by a copy of Plaintiff's trust fund statement showing all transactions in his account for the six-month period immediately preceding his initiation of this action; or (2) pay the full statutory filing fee of $402.00. Failure to comply with this order by July 26, 2022 will result in summary dismissal of this case. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released. Failure to keep the Court informed of his address may lead to dismissal of this action for failure to comply with a Court order and for want of prosecution.
