After inquiring of Plaintiff and for the reasons stated on the record, the Court finds that venue is not proper in the Northern District of Illinois and thus transfers this case to the United States District Court for the Southern District of Indiana pursuant to 28 U.S.C. 1406(a). In summary, under 28 U.S.C. 1391(b), a civil action may only be brought in: "(1) a judicial district in which any defendant resides, if all defendants are residents of the State in which the district is located; (2) a judicial district in which a substantial part of the events or omissions giving rise to the claim occurred, or a substantial part of property that is the subject of the action is situated; or (3) if there is no district in which an action may otherwise be brought as provided in this section, any judicial district in which any defendant is subject to the court's personal jurisdiction with respect to such action." Here, based on the allegations of the complaint and as confirmed by Plaintiff at the status hearing, Defendants all reside in either Valparaiso, Indiana or Carmel, Indiana (mistakenly alleged as "Cannel, Indiana" in the complaint), and the conduct about which Plaintiff complains all occurred in Valparaiso, Indiana. Accordingly, venue would be proper in either the Northern District of Indiana, where Valparaiso is located, or the Southern District of Indiana, where Carmel is located. By contrast, there is no apparent basis for venue in the Northern District of Illinois. In addition to the fact that no Defendant resides here, none of the relevant events occurred here, and the subject property is not located here, it appears doubtful that this Court would be able to exercise personal jurisdiction over any Defendant. While the Court acknowledges Plaintiff's stated concern that he will not be treated fairly if the case is heard in Indiana, his "claim of bias lacks factual support and is not a basis to find venue proper." McFarland v. Hous. Auth. of Racine Cnty., No. 20-cv-583-wmc, 2021 WL 738837, at *2 (W.D. Wis. Feb. 25, 2021). Accordingly, this case will be transferred to an appropriate district court in the State of Indiana. Either the Northern District of Indiana or the Southern District of Indiana would provide an appropriate venue. On the record, Plaintiff expressed his preference for the case to be transferred to the Southern District of Indiana. Because venue appears to be proper there, the Court transfers the case to the United States District Court for the Southern District of Indiana. Plaintiff's application for leave to proceed in forma pauperis #3 , motion for a temporary restraining order #6 , motion for attorney representation #27 , and motion to preserve evidence #28 , as well as any other pending motions, will be deferred for ruling by the transferee court.
