Filing 14 MINUTE entry before the Honorable Gabriel A. Fuentes: This matter coming before the magistrate judge on referral (doc. #13 ) for discovery supervision and settlement, the Court has reviewed the parties' status report (doc. #11 ) and the district court's recent order (doc. #12 ) and sets the discovery schedule as follows: Rule 26(a)(1) disclosures and written discovery requests are to be issued on or before 9/30/22, and fact discovery cutoff initially is set at 6/2/23, as the proposed 9/29/23 fact cutoff strikes the Court as long. The setting of an expert discovery schedule is deferred at this time and will be revisited once the Court has a greater sense of whether the parties will be able to adhere to the 6/2/23 fact discovery cutoff, and pending any settlement conference that may occur, as the parties have suggested that they may seek once fact discovery concludes. The parties are further directed to review the Court's Standing Order for Civil Cases Before Magistrate Judge Fuentes and the Top Ten Ways to Defeat Settlement, both available on the Court's website. A further joint written status report is due and to be filed by noon on 1/13/23 concerning progress toward closure of discovery. Filing 7 MINUTE entry before the Honorable Joan B. Gottschall: Defendants' Local Rule 3.2 notifications of affiliates (Nos. #4 and #5 ) state that each corporate defendant "does not have a parent corporation and no publicly held affiliate/entity owns 5% or more ownership interest in the corporation." Effective May 5, 2022, Local Rule 3.2(a)'s definition of affiliates was amended as follows: "For purposes of this rule, 'affiliate' is defined as any entity or individual owning, directly or indirectly (through ownership of one or more other entities), 5% or more of a party." See N.D. Ill. Gen. Order No. 22-0009 (May 5, 2022). As amended, the definition requires disclosure of all ownership interests, and all entities and persons meeting the definition of affiliate must be identified, including natural persons, if any. Filing 6 ORDER: An initial status report and, if appropriate, case management plan is due on or before August 17, 2022. The joint initial status report must indicate whether this case is related to any other pending case and whether this case is a refiling of a previously dismissed or remanded action. See N.D. Ill. LR 40.3(b)(2) and (3). In conformity with General Order 21-0027 and due to the need for social distancing during the COVID-19 pandemic, this court is ordering written status reports instead of routine oral status hearings. This includes initial status hearings and scheduling conferences under Fed. R. Civ. P. 16(b). See Judge Gottschall's website for the procedure for requesting a hearing and for requirements for status reports and discovery plans during the COVID-19 pandemic. No Rule 26(f) discovery plan should be submitted until all plaintiffs have been served. If all plaintiffs have not been served by the deadline for filing an initial status report, the report should so state and propose a deadline for filing a discovery plan. The parties are directed to discuss settlement and whether they consent to proceed before the Magistrate Judge. They are further directed to meet and confer regarding a proposed discovery plan.
