August 25, 2022 Opinion or Order Filing 7 ORDER: Plaintiff submitted an undated complaint #1 that arrived on July 26, 2022, in an envelope without a postmark. He did not pre-pay the filing fee or seek leave to proceed in forma pauperis (in other words, request permission to pay the filing fee in installments). Plaintiff initiated a prior lawsuit where he also submitted a complaint without addressing his fee status. Ramones v. Kelley, Case No. 22 C 3072 (N.D. Ill.) ("Ramones I"). In Ramones I, on June 24, 2022, the Court directed Plaintiff to prepay the fee or seek leave to proceed in forma pauperis and warned him that his lawsuit would be dismissed if he failed to comply. Id., Dkt. 3. Since Plaintiff was advised of this information in Ramones I, it is unclear why he again initiated litigation without attempting to address his fee status. As he decides how to proceed, he should reread the June 24, 2022 order in Ramones I, which contains information about inmate filing fee obligations. For this case, Plaintiff must either: (1) pre-pay the full $402 filing fee; or (2) submit a properly supported application for leave to proceed in forma pauperis. If he does not do so by September 26, 2022, the Court will summarily dismiss this case. Plaintiff is placed on notice that if he initiates additional litigation, he must pay the full $402 filing fee or seek leave to proceed in forma pauperis when he submits his complaint. If he fails to comply, his new lawsuit will be subject to summary dismissal without prejudice to refiling, and he will be liable for the filing fee in both the dismissed and refiled cases. August 9, 2022 Filing 5 MINUTE entry before the Honorable Martha M. Pacold: Plaintiff's letter dated August 1, 2022 #4 is before the Court. Plaintiff has inquired about forms he believes that "all the parties" need to sign. He previously submitted two magistrate judge consent forms #3 with the names of the Defendants printed on the lines provided for the parties to print and sign their names. Plaintiff is advised that that he may consent to have a magistrate judge preside over this case, rather than this Court. However, he may not consent on behalf of another party. Regardless of whether Plaintiff consents, this case will remain before the Court unless all the parties consent. Defendants have no obligation to take any action at this point because, among other things, the Court has not yet addressed Plaintiff's fee status or decided if he may proceed with his complaint. The Court will issue an order addressing Plaintiff's fee status in the normal course. He should be aware that regardless of the outcome of this litigation, he will be required to pay the filing fee, either upfront or over time, as waiver of the filing fee is not an option, even if a litigant is in custody.
